I know, I know…estate planning is not the most popular subject but it’s absolutely essential, especially when you own real estate. Either your own home or that plus investment properties.
If something happens to you and you don’t have in writing what you want done with your property, it can be a real mess. Why not just deal with it and give yourself and your loved ones the piece of mind knowing exactly what your wishes are. No one has to guess and you can just relax.
No one wants to talk about it or do it because it reminds us of the inevitable fate of all human beings. The fact is, not doing it doesn’t make it go away and you don’t want to wait until the last minute.
In my 10 year real estate career I have had clients who contact me to sell their parents’ home, or a friend’s home, either after they’ve passed or after they have become incapacitated, and there is no will in place. If the REALTOR(R) doesn’t have this document to show who has the authority to sell the home, we cannot help you. We must see documentation of who has selling authority in order to put the house up for sale.
I have also had experiences with clients who have purchased a home, and they passed away suddenly after they purchased. In one certain instance, there was a will in place and thank goodness as the family was understandably devastated. Imagine having to deal with this sudden death, and now you have to deal with the estate without a will? Either of those is difficult enough on their own.
You have spent way too much time, sweat and tears to buy your home and/or investment properties so don’t leave it to the last minute or the government to decide what happens to them after you pass.
